My Niece, Rachel Morris, was killed in an automobile accident on Oct. 26, 2007. That's enough of a tragedy. She had been the passenger of a girl who, for some unknown reason, decided to drive at over 100 miles an hour in a 35 MPH residential area. She lost control of the car, hit some concrete mailbox stands, anf flipped the car over, killing my 20 year old niece instantly. the girl has been charged with negligent homicide.
now for the stupid part. Her father (the driver's, not my brother-in-law) is suing the owners of the mailboxes for causing Rachel's death. That's right. I'ts somehow THEIR fault, because the concrete stands didn't break away when she slammed into them at 100 miles an hour. He's even gone so far as to draft a bill, which he tried to name the "Rachel Morris Bill" until my sister's lawyer told him on no uncertain terms that he is to keep her name OFF of it, that would make concrete mailbox stands illegal in Florida. This numb-nuts will do ANYTHING to avoid admitting that his spoiled brat of a daughter caused Rachel's death with her reckless driving! he even went so far as to try and woo my sister and her family into the lawsuit, assuming that they had the same low principles he does. They promptly told him where to stuff it.
What kind of people think that way? isn't it bad enough that my niece is dead? isn't it bad enough that this girl is probably going to go to prison, or at the very least LIVE with knowing that she KILLED HER FRIEND? Why does he have to bring innocent people into it, and make them suffer? those mailboxes did not jump out in the middle of the street and cause that accident! The blame lies ENTIRELY with the driver, who was being irresponsible, foolish, and reckless. the blame lies no-where else. -

Herbert W Armstrong had it right. This society lives the "get" way of life, me me me. Until we do it God's way, the "give" way of life, nothing that men do surprises me.

exactly. the guy is only doing it to cover his own butt from his insurance agency, since the car was in his name.

only in the US can anyone sue for anything...
it is easier to blame such harsh things on exterior influences than internal ones. my thought is that there was a different reason for 100 mph than they are saying. -

oh I know what the reason was! the driver was bi-polar, off her meds, and on cocaine to boot. her father knew about her mental condition, as well as her drug habits, and let her drive anyway, and now he's suing to cover his arse from his insurance company who is on him like ugly on an ape. She is looking at 15 years for vehicular manslaughter( plus another 15 for felony DUI), and he's looking at 5 to 10 for criminal negligence. so, as much blame as they can shift onto someone else, is less blame they're going to have to take themselves.

coming from a complete outside view...
you are both right. if the mailboxes were not cement, they probably would be alive, and if they hadnt been going so fast, they probably would be alive.
just lookin at the situation from all angles.... -
i'm sorry for your loss and I hope father of the driver relizes hes just hurting you and your family.
