Rape... Do you believe this is classed as rape?

A 16 year old boy has sex with somebody with some form of mental deficiency she is 14/15... She consents but does she know what she is doing? Is this rape?

    Firstly, you need to decide what bothers you most, the ethics of his actions, or the legality. The age of consent varies from country to country, and, in the US, from state to state. In Burkina Faso the age of consent is 13, while in Pakistan, ALL sex outside marriage is illegal. The age of consent is an arbitary figure that varies from culture to culture.

    In my opinion, sex between teenagers where there is only a year or two difference may not be wise, and in this case not strictly legal, but if it's mutually consentual, and there has been no force or violence, I would be satisfied that there has been no rape...ethically speaking.

    I believe that mentally handicapped people may need guidance on certain matters depending on their disability, but I don't believe that anyone has the right to deny them a healthy sex life.

    This girl will most likely have this handicap for the rest of her life, are we saying that anyone who has sex with her during that time is also a rapist because her handicap means she is unable to make informed decisions?

    Without more information as to the specifics of the girls handicap, whether she was a virgin or not, the relationship between the two etc., I can't make a black or white judgement as to the ethics, so I would say give him the benefit of the doubt.

    It sounds to me like a typical case of two teenagers experimenting with sex, perhaps unwisely, where one of them happens to suffer from a handicap.

    Thats an interesting question, I believe it would have to weighed on a case by case basis, I dont believe that a blanket law can be made to fairly cover all the bases

    This is what my boyfriend had done in the past and I want to clarify if this is rape. I can't go out with someone if they have raped someone life has been hard enough with guys being too physical with me... Tell me what you think.

    you have to analyze this from all angles. you have to look at what their relationship was - were they friends or neighbors or wee they together... what? age is not the thing really, most states declare statutory rape after someone is 3 years older than the other person.

    you also have to look at the severity of the girl's handicap. most handicap people with mental defficency are able to comprehend enough basic information to decide what is good and bad. anyone with a handicap that can learn and retain information is given the opporitunity and knowledge about these types of things. i know first hand because my aunt s mentally challenged and she was taken to classes that taught how to function around other people and relationships. if she was given sex education and violation classes then she would have been able to make a valid consent. in which case, it cant be classified as rape. consent from two willing and mentally sufficient people. just because someone has a mental handicap doesnt make them stupid or invalid to awareness.

    you have to take into account the feelings of the boy before stating whether or not he was using her - maybe he cared for her. maybe he didnt. maybe he has a mental issue as well, granted not severe enough to classify as mental handicap, but maybe depression or a severe attatchment disorder.

    what was done may not be right but the morals of teenagers cant be used as a factor here. there are people 12-13 years old having sex. in reality there is no law that says anyone under the age of 18 cannot have sex, only laws placing age limits. certain ealities need to be realized: people do what they want with or without morals. ethics are seriously lacking in society in most areas anyway.

    but if she knew enough to facilitate the act, she knows a basic concept of what it is. there was a similar situation like this on Law & Order: SVU i think lol.

    i would consider this rape.... for a start she is under the age of 16 which means she isnt ready for sex anyway! ! He is 16 and so is old enough to know right and wrong, he should know that she is mentally unstable or has a 'mental deficiency' and therefore may not understand the concept of sex ( depending how severe her deficiency is )She may not have any idea of what she is doing. If they were in a relasionship and trust eachother then...my opinion would differ but to me this is rape. From the statement i would say he was taking advantage.

    Yes it is rape. Society says that age means nothing. Any sex under the age of eight-teen is hugely frowned upon. Depending, massively, on how severe the retaurdation is her consent means nothing. Actually any retaurdation means absolutely everything, her consent is completely and totaly worthless. I don't mean to be heartless, but unless they were married, which I assume they were not, it was rape because she couldn't choose like someone of a more stable mindset.

    Firstly it is rape because she is menatl so she isn't sure of wat she is agreeing to and she is undreage(so she is proberbly making some immature&irrational descicion)

    On the other hand it isn't. The society we live in says that as long as both people agree to do something, then it CANNOT be classified as rape. it is your choice.

    Isnt this all opinions??? Well wasnt the person that finalised the age limit of sex to be over 16 influenced by opinions? His opinion? i dont believe that there should be an age limit and it is the boy and girls opinion on the fact of whether it was rape as the girl consented and it is not stated what her mental defficiency was. so i think the best answer for this is to ask them if possible or not to make judgements

    To take advantage of someone who is mentally handicapped and who does not descent is sexual molestation. Forcing sex on someone who does not consent is rape.
